Selected TED/TEDx talks on privacy and reputation

In an increasingly inter-connected and digital society, challenges to privacy and reputation are frequent.  Even before social media put everyone at constant pressure to “overshare,” when people’s very personal details were not always a quick Google search away, privacy was still under threat.  A person’s visibility and public representations are often judged and demanded for credibility and honesty evaluations performed by employers, potential partners, members of the community, and even complete strangers.  Giving up privacy in favor of radical openness may be the way some reality stars have attained their celebrity, but for many people this feels invasive and like a violation of security.

In a broader sense, people’s individual privacy settings in terms of what they wish to share or disclose, how, and to whom, have a direct bearing on reputation.  Cultural practices around privacy and information sharing can give rise to serious reputational risk that impacts individuals and communities and frays the social fabric in which transparency is desirable or even possible.  These norms and ethical expectations are intensified in the digital age, where an individual’s personal information can never truly be deleted or taken back once it is made public.

Compliance and ethics in Groundhog Day

Groundhog Day is a classic comedy film from 1993.  The movie centers around Bill Murray’s character Phil Connors, who is a weatherman on-location in Punxsutawney, Pennsylvania covering the annual Groundhog Day event there.  The town’s festivities around the ritual of the groundhog coming out of his hole to check whether or not he sees his shadow are a huge media event and popular celebration which Connors, who is generally obnoxious and condescending, finds ridiculous.  On February 2, Connors has an unpleasant and miserable day in which he is annoyed by everyone around him, acts out, and totally fails to charm his producer Rita Hanson, played by Andie McDowell, with whom he is in unrequited love.  The next day he wakes up and is alarmed and confused to find that it is not a new day and February 3, but rather it is February 2 again and the prior day is repeating exactly as it happened before.

Connors winds up trapped in a time loop in which only he is lucid of it.  He experiences February 2 over and over, with his memory and knowledge retained but otherwise no evidence in the world or other people that the day has happened before and will happen again.  Connors goes through a complicated process of reckoning with this reality and ultimately makes an ambition of getting Hanson, who hates him, to fall in love with him.

Justice in Black Mirror

As previously discussed on this blog, the universe of the science fiction show Black Mirror is very interesting from a compliance and ethics perspective.  As discussed in this post about the first three series of the show and this post about the fourth series, the show often focuses on connections between humanity and technology.  The show frequently contemplates the negative impact of excessive or dangerous reliance on technology and warns of the disruptions to people and communities that could result from overly integrating advanced technology into life.

While the most common themes of Black Mirror indeed pertain to traditional risks of overuse of technology, such as data privacy, consent, artificial intelligence, and cybersecurity, there’s an additional layer of commentary on the show which focuses on broader social issues, such as power, community, and justice.  Indeed, the question of how a technologically-advanced society might define and handle justice uniquely is compelling.  Portrayals of justice throughout all four series of Black Mirror include the treatment of issues such as punishment, reparations, confessions, investigations, judgment, and surveillance.

Compliance in Black Mirror Series 4

Black Mirror’s fourth season continues the themes of the previous three series of the show.  As discussed in this post, the show makes often uncanny connections between human life and technology, frequently covering the ways in which social media, AI, biometric devices, and other advanced technological systems and devices affect and change society.  What makes Black Mirror so effective, and often so disturbing, is that in each of the anthologized stories it contains not only a vision of the future but also a warning about the disruptions that would happen to people along the way.  The reality depicted in Black Mirror is like an amped-up version of the world that seems to be already nearly within reach, with technological advancements abound to make life easier or more entertaining.  However, the point of view in the show is markedly dystopian, forcing viewers to consider the addictive or even dangerous influence that immersive technologies could have.

Selected TED/TEDx talks on integrity

Integrity as both a personal and an organizational value is one of the central and recurring themes of this blog. Promoting and supporting integrity in individuals as well as in the groups in which they live and work is essential to encouraging cultures of compliance and ethical decision-making. Indeed, the foundation of the moral conduct people wish to see in each other and in their institutions in order to enhance the stature of truth and honesty in today’s complicated, interconnected world starts with placing personal emphasis on integrity and character ethic. With a strong and well-articulated individual commitment to moral engagement, people can purposefully contribute to the integrity of the communities in which they live, the groups in which they gather, and the organizations in which they work.

  • Aligning integrity with identity (Lester Tanaka) – Commitment to any character ethic value must be authentic. A person cannot decide to have integrity without actually embracing the honesty, judgment, fairness, transparency, and credibility that goes along with possessing this trait. Claiming to have it, without actually genuinely imbedding it, goes against the grain of the entire concept of integrity itself. Therefore individuals must, as Lester Tanaka suggests, make concrete and meaningful for themselves the interrelationship between the mental and the moral. A person’s identity should be aligned with and connected to the value of integrity and their intention to live with it. Therefore, all the other traits for which an individual has an affinity should be consistent with the goal of integrity. Self-examination and self-reflection will be both necessary to identify these corresponding characteristics as well as important for thoughtful and organic personal integrity.

 

 

  • Integrity as a currency for leadership (Barth Nnaji) – Integrity is also a core value for leadership. When faced with opposition or adversity, challenge or doubt, ethical leaders can always rely upon their integrity to represent themselves as credible, rise above the fray, and maintain a firm grip on ethical standards for decision-making and conduct. One of the differences between a manager and an ethical leader is, in fact, this commitment to their sense of integrity and the feeling of a strong responsibility to resist negative temptation or becoming overwhelmed by the magnitude of their tasks. True leaders stick to their own values and indeed promote their own integrity as the “currency” needed to get things done in collaboration with other people and organizations. Leaders who consider their reputations as one of their main assets would seek to protect the way they are seen by others by staying true to the expectations for their credibility and reliability. This way, people who lead with integrity become people with whom others wish to be associated, compared, and involved.

 

 

  • Building integrity – keeping promises (Erick Rainey) – Establishing integrity does not have to be an academic or theoretical challenge with abstract and lofty metrics by which its success is measured. Having integrity is as simple as keeping promises. Walking the walk, taking responsibility, and following through are simple but incredibly impactful actions which, when repeated, establish a pattern of integrity and worthiness of trust and reliance. This goes for individuals as well as for organizations. Delivering on commitments or being honest and transparent about it when it’s not possible to do so puts the value of integrity into powerful action.

 

 

  • Integrity and authenticity don’t make you trustworthy (Struan Robertson) – As noted in this earlier post, expectations for and ideas about trust, honesty, and the truth are all being transformed by today’s digital society. Shifting moral evaluations and perceptions of what is or is not true too often promote a convincing and compelling brand of dishonesty over difficult or complicated truth. In this environment there are many complex factors against true credibility and integrity. Simply appearing to be “good” or wanting to identify others as “evil” is not sufficient. Being relied upon is also not the same as being trusted or trustworthy.   As discussed above, commitment to integrity has to be both authentic and practical. An individual and all the individuals which make up organizations have to have an organic, real commitment to integrity in order to truly act with it, rather than to just pretend or attempt at it.

 

  • Integrity and the Life of the Planet (Zale Zeviar) – Apart from the integrity of individuals in both private life and the work place, corporate integrity is so important in society’s attempts to solve huge challenges, such as making environmentally-friendly consumer choices. The transparency and openness that acting with integrity and moral certitude can bring is also applicable to business core values. Accountability for earth-friendly business practices and products is just one expression of corporate social responsibility that exhibits business integrity. Small changes by consumers can be enabled by community and business values which can help the whole system to aspire to a higher level of integrity. This “corporate consciousness” is an active expression of integrity that spreads, aligning all the players in the chain universally around integrity as the common theme.

As shown above, defining integrity as a core value in all areas of life – self-identification, leadership, relationships with others, community engagement, social responsibility – is a powerful, purpose-driven approach. A commitment to recognizing integrity as a virtue and using a strong internal sense of its importance for one’s personal moral code enables individuals to be credible and responsible and to model these values to each other. With time, institutions and organizations will reflect the integrity promoted by the individuals within them, elevating the ethical register of society.

Compliance and ethics questions from The Good Place

The Good Place is a US television comedy series.  The show is about a group of people who are in the afterlife and must contend with their ideas about their own moral conduct, both before and after they died, as well as general perceptions of right and wrong.  It draws heavily from the fantasy genre to make amusing and provocative philosophical observations on this theme.  The characters grapple to develop their own internal moral registers, teach and learn from each other about morality, and contend with their existential ideas about the impact of good or bad behavior and personal ethics.  Their home in the afterlife is a planned community with set rules and choices within which they attempt to identify and define their senses of morality.  They are supervised in this process by an “architect” who functions as the executive of the community as well as a human-like android that uses artificial intelligence to provide virtual assistance.

In light of this very pertinent setting, The Good Place poses many questions and dilemmas about moral behavior and ethical decision-making.  It touches upon classical theories from philosophy as well as very practical questions about conduct, governance, choice, and design ethics of artificial intelligence.  Above all, questions of individual and organizational integrity, and the creation of shared code of ethics and culture of compliance are dominant throughout the series.

Here is a selection of some of the most interesting of these questions from the first season and a half of the show (with plot spoilers and proposed judgment/answers avoided for now in order to invite contemplation about these dilemmas which can have a variety of personal and provocative answers, just like all ethical dilemmas… future posts will offer more specific commentary on how these dilemmas could be approached and utilized in practical ethics and corporate compliance scenarios):

  • Flying (Season 1, Episode 2): Can someone be taught to be good?  Can an imposed ethical code be a genuine one?  Can a “bad apple” who does bad things but is instructed and prompted to do good things become a “good apple”?  What role does nature or nurture have in determining how moral a person is or how ethical an individual’s conduct is in a variety of situations?
  • Tahani Al-Jamil (Season 1, Episode 3): Can a individual be good if the world itself in which the individual lives is bad?  And if it’s possible, what’s the point?  Can good people turn the world, or even part of it, from bad to good or is their virtue futile?  If people aspire to be good but bad things happen anyway, does that justify continuing to try to be good in face of adversity and negativity?  In unethical and immoral cultures, what convincing reasons is there for good people to not do bad things?
  • The Eternal Shriek (Season 1, Episode 7): Can humans murder machines?  Is rebooting an android, no matter how humanistic and realistic it may be, killing?  And androids and other humanistic robots different from devices that look like computers, because they are designed to look like people?  Can machine learning progress to the point where it is consciousness, or will it always just be mimicking this human trait?  If this deep learning is deleted or reset, what are the ramifications for knowledge and language acquisition?  Does something have to be alive first in order to die?
  • Chidi’s Choice (Season 1, Episode 10): Is not choosing a choice? If so, is it ethical or unethical to not decide because of moral uncertainty about the options?  Does over-engineering choices make the ethical ramifications of them too remote for the decider to choose fairly?  Is indecisiveness unethical when it leads to preventable harm?
  • What’s My Motivation (Season 1, Episode 11): Does good conduct only matter if it’s for a good reason/pure motivation? Is there objective good or should people’s actions be intended to meet some subjective but agreed-upon standard for “goodness”?  Does altruism have to be intentional or can one person’s selfish actions still benefit others, and what credit does the selfish person?  Does getting or wanting credit make a difference in moral assessment?
  • Michael’s Gambit (Season 1, Episode 13): What are the implications on liberty and consent when people are provided with limited choices?  Are there design ethics to choice when there is an institutional architecture within people conduct their decision-making ?  In libertarian paternalism, what is the responsibility of the people who select the available choices (make policy and implement governance) to the end-users that make the ultimate decisions?
  • Team Cockroach (Season 2, Episode 4): Do ethics require individual consequences to be meaningful?  In order for people to care about doing the right thing, would the wrong thing have to hurt them personally?  How can decision-making processes fairly consider and reflect possible consequences and outcomes in order to encourage integrity and adherence to personal moral standards, even when the individual has nothing to directly lose or gain?
  • Existential Crisis (Season 2, Episode 5): Are ethics human only?  If there is consciousness, is there morality?  If ethics are existential, are there some ideas that are unitary or universal?  Or, like justice, is ethics too heavily invested in social and cultural background to have a broader application?
  • The Trolley Problem (Season 2, Episode 6): Can philosophical ethics and practical ethics be reconciled?  Are clear-cut judgments of right and wrong or definitive moral assessments only possible in theory?  Does reality introduce too much noise from personal opinion and prior experience for moral dilemmas to be considered and answered objectively and truthfully?  If people do not remain within the boundaries of the dilemma and bring in too much outside information, are they gaming the dilemma?
  • Janet and Michael (Season 2, Episode 7): Do machines have morals?  Can artificial intelligence give them a moral code?  Will it be the same as that of the humans that engineered the deep learning?  Could it differ and what will humans do if it does?  What is the ethical responsibility for designers to consider this potential of technology now and how can it be controlled or addressed for the future?  What happens if it goes wrong?

The above is merely a selection of interesting ethical dilemmas posed by The Good Place as the characters struggle individually and as a group to define their moral code and set expectations for their own conduct and choices within it.  It will be interesting to see where the series takes these very relatable and thought-provoking questions, and what additional ones emerge, as the story continues.

Selected TED/TEDx talks on justice and ethics

One of the most poignant and timeless discussions related to ethics is the concept of justice. Justice is the measurement of fairness and is defined by theories which vary wildly between and within cultures and countries. Administration of fairness is as crucial to ethics as are, for example, other fundamental ideas of morality such as trust and honesty. Theories of justice may focus on equal distribution, individual treatment, societal consequences, or even punishment and reparations. These differing theories all have their own foundation in a culture’s ethical values and are then impacted by historical events, jurisprudence, or religious beliefs in a variety of ways. Even though justice is so varying and individual, efforts toward and desires for it are indeed universal, and the ethical fundamentals of its moral pursuit are shared as well.

  • Justice is a decision (Ronald Sullivan) – Wrongful convictions are a particularly distressing and compelling example of injustice and need for justice-based reform within the legal system. If an innocent person is incarcerated, he or she is unjustly deprived of freedom, and the victim of the underlying crime misses out on true restoration or reparations as well. Ronald Sullivan argues for the importance of advocacy as the defining competency and mission of criminal law attorneys, especially public defenders. Working as an advocate with the mission of serving justice and ensuring that the individuals in a case are not subjected to injustice positions lawyers to address a moral good and employ the most ethical mode of legal representation.

 

 

  • Errors of justice (Asbjørn Rachlew) – Related to the above, wrongful convictions have an obvious striking and lasting impact on the innocent people who are sentenced to jail for crimes they do not commit. In this talk, Asbjørn Rachlew discusses wrongful convictions from the perspective of a police superintendent, especially focusing on those which included false confessions and intense, coercive investigations. From this perspective, Rachlew delves into the root causes for these errors of justice, helping the wrongfully convicted to see the reasons outside of themselves for their injustice as well as helping police and other authorities to understand their responsibilities and the consequences of their actions. For any moral society, thinking about the impact of these errors and the very real damage that can be done to humans because of injustice is a necessary ethical consideration and one that should lead to reform and better practices to ensure that justice is a higher priority.

 

 

  • Why Justice Isn’t Enough (Barry Schwartz) – Justice and morality go hand in hand. For a society to be considered moral or on the “good” side between right and wrong, justice must be a respected virtue. A just society is an ethical society. In most cases, this is clearly represented by a distributive system of justice where people deserve what they get and get what they deserve. Both of these outcomes may seem rare to many people, at least from a perception perspective. Indeed, in education, jobs, social standing, and material success of all kinds, people that are seen as having merit often go without while others who appear less deserving or have not worked diligently toward goals nonetheless get everything they could want anyway. The differentiating factor is sometimes just luck. Therefore considering and appreciating the importance of luck could increase social justice and administration of fairness and equitable treatment between individuals who are just as deserving as one another but haven’t been as lucky.

 

 

  • What is Fair and What is Just? (Julian Burnside) – What is the role of moral response in justice? What ethical responsibility do individuals and their communities have do something when confronted with injustice? This starts with defining fairness and justice. Just as people must have internal moral codes and ethical registers in order to have any ability to contribute to organizational ethics and integrity within groups, communities, or countries, people must also have individual definitions for and understandings of fairness and justice. Sensitivity to unfairness, and concern with fairness and justice, is an ultimate expression of compassion and a high moral value. The struggle for justice is universal, and is plagued by differing interests and values as well as the desire of many to not engage in confronting difficult or distressing situations, but sincere efforts toward it must be made by ethical individuals.

 

  • What if justice was something we felt (Ardath Whynacht) – The role of compassion in justice is a powerful evocation of the morality of striving for fairness. As demonstrated in the above talks, there are complicated forces that work against understanding and achieving justice. However, the social and ethical benefits of the effort to all involved are great enough to justify trying. Perhaps justice is more appealing and concrete of a goal if people approach it from a compassionate, humanistic perspective rather than from a legal or abstract wealth and rights distribution basis. Seeing justice from an emotional perspective, and acknowledging its restorative and connecting power, can transform the incentives in society to seek it.

In application, justice and the ethics of its interpretation and attempts to reach it in society is a major topic in the modern legal system, with the actions and decisions of lawyers, judges, and parties to cases all having major influence on the execution of different efforts toward fairness. Individual entitlements, such as to property, other wealth, basic goods, and social status, are also distributed with questions of equal rights or arrangement of inequalities under some vision of justice and ethics. Finally, as provocative as justice itself is the concept of injustice, or errors of justice, and how damage from this can be acknowledged, avoided, or corrected.

Compliance in The Circle

The 2017 movie The Circle, based on the 2013 novel of the same name by Dave Eggers, is about the impact of commercial technology on human life.  It poses common ethical and moral questions about privacy and security in a time of interconnected information sharing via social media and networked devices. The movie is a thriller which centers around a tech giant that offers advanced products and services that have transformed the way people do business and interact with each other by placing all interactions on various platforms and networks with ratings and sharing capabilities.

While the high-tech immersion depicted in The Circle is not yet current reality, technology is developing at a breakneck pace and social media platforms, the Internet of the Things, and services driven by algorithms and other artificial intelligence and machine learning are increasingly ubiquitous with each passing day. At its core The Circle is concerned with overreach of these technologies and the companies that develop and market them, and the ethical problems and moral challenges that can arise from human and societal interaction with them.

  • Secrecy as dishonesty – One of the central philosophical proclamations of The Circle is when the protagonist, Mae, is confronted with a legal transgression she committed and in her reckoning with her actions states, “Secrets are lies.” Mae’s central thesis is that she would not have committed her crime if someone had been watching or aware of what she was doing. Therefore, the suggestion is that secrecy is a form of dishonesty. Disclosure, on the other hand, is the ultimate truthfulness and in this perspective, is valued over privacy. Privacy enables people to lie and conceal, and therefore leads to misconduct and distrust. Individuals giving up their expectations of privacy would supposedly lead to greater overall security and trust. The tension between liberty and safety is not an unfamiliar one in society. The dilemma of which takes precedence will be an on-going and dominant moral dilemma.

 

 

  • Transparency overload – It’s easy to agree that transparency and openness encourages honesty and communication. Clear and public disclosure of organizational activities and values provide strong incentives for making the best ethical decisions and keeping integrity in mind when planning business strategy. However, the admirable mission of transparency is subject to subversion, as The Circle Claims of public transparency can be selective, creating an impression of a company that values openness and progressive values when in reality it is picking and choosing disclosures while hiding malfeasance and abuse behind this self-selected façade. Also, going too far in claiming transparency on a personal level can be too much of a good thing. As above, the tension between personal privacy and public disclosure is a delicate balance which must be worked thoughtfully.

 

 

  • Surveillance and consent – In promotion of corporate and societal values of transparency and shared disclosure, the company in The Circle introduces a service where tiny cameras are embedded everywhere out in the world. Some of the cameras are installed intentionally by users who wish to share, but others are placed in a variety of public locations without notification or permission to do so. The video streaming from the cameras are publicly available online for searching, indexing, and manipulation. While being able to see a high-definition and flexible feed of the surf at a beach is appealing for a number of reasons, cameras everywhere in public, regardless of their utility or entertainment value, can also be used by both private and public concerns to conduct surveillance. As these cameras are in some cases posted without consent or knowledge, this surveillance is vulnerable to unintended uses and can represent, as above, serious risks to personal rights and privacy expectations.

 

 

  • Cybersecurity – The company in The Circle develops, markets, and sells a technology service. Therefore the people who buy what they market are not only purchasers or customers but also users. They have heightened expectations and rights for protection by the company as such. Not only is the extent to which their data is collected by the company questionable (even when the users are intentionally sharing it in an excessive or imprudent manner), but the company also is obligated to store it, and may violate individuals’ rights by viewing it, accessing it, analyzing it, or not keeping it safe from intrusions by and alterations, deletions, or other misuses of, its employees or third parties. Cybersecurity risk management is a huge challenge for a company such as this one, which is clearly putting its commercial and societal ambitions over any fundamental value of information security that is discernible.

 

 

  • Unethical decision-making – While the titular company in The Circle repeatedly suggests that transparency can be a force for good and should be leveraged for this purpose by the widespread use of what boils down to be surveillance technology, reality of how humans use this technology show that its use and influence is not straightforwardly positive at all. Quite to the contrary, on many occasions in the movie disclosures and discoveries due to the technology are harmful to individuals and relationships. Despite the desire to incentivize honesty and normalize total disclosure, people end up getting hurt, both because of their own overzealous adoption of the technology and of the actions of others. In the most dramatic example of this, a person dies due to a series of events kicked off by a crowd-sourced surveillance operation performed at a company demonstration of their new service. Unethical decision-making, both in questionable design ethics by the organization and in immoral behavior by user-individuals, directly causes these tragic and disturbing events.

 

 

There are many ethical and moral dilemmas posed by availability of advanced technology which can encroach about privacy, security, and consent of individuals. Transparency, surveillance, and risks to information security and from cybersecurity are all common themes of The Circle as well.

Selected TED/TEDx talks on values-led people and organizations

A successful and robust corporate compliance and ethics program will have a blended focus on rules-based and values-based controls. Taking an integrated approach to performance and conduct is necessary in order to facilitate awareness of and adherence to compliance risk management efforts and expectations. Rules and values cannot be separated, and should indeed be balanced together to make the most compelling call to action by employees and management.

Legal and regulatory guidelines and company policies and procedures form a clear foundation for the rules and make up the structural, mandatory portion of a compliance program. Deriving this from external and internal requirements is somewhat straightforward and can be accomplished with methodical planning and continuous updating and education.

Values, on the other hand, form the ethics discipline and come from the moral codes of individuals and the commitments to integrity made by the organizations within which they work. While more resistant to obsolescence than rules and regulations, values are far more challenging to identify and express, and even harder to imbed authentically and sustainability within a corporate culture. Values provide the voluntary motivation for doing the right thing at the right time for the right reason, despite forces or interests that may impede or work against that, and including when taking this action requires inaction.

Therefore successful compliance professionals will rely upon the basis provided by rules, while evoking the emotional and personal appeal of values. Providing incentives for inner success and enabling individuals to make ethical decisions and act with integrity gives purpose to employees and credibility to organizations.

The below TED/TEDx talks emphasize the importance of values-led people and organizations and the ways they impact society, interpret ethics, and define success.

  • Why we need core values (James Franklin) – Similar to earlier TED/TEDx lectures shared on this blog, ethics in organizations and society in general begin with individuals. In order for individuals to define the internal moral registers and inform their ethical perspectives based upon them, they need to establish personal core values first. Adopting core values – inalienable individual ideas about right and wrong – is crucial in approaching life and work with purpose and conviction. Understanding core values helps to move on from failures productively, build on successes sustainably, and improve all relationships and ambitions. Individuals as well as the communities in which they live and organizations in which they work can all benefit from planning and mission statements which are grounded in individual articulated core values.

  • The transformative power of values at work (Mika Korhonen) – Well-meaning human resources managers and consultants can too easily lose the root of employee motivation and awareness efforts – that employees are people too. The person an employee is outside of work, and the values he or she possesses in private life, must be leveraged in the workplace to create genuine engagement in both compliance culture and in daily work in general. Leadership and growth requires resilience to change, endurance through adversity, and cultural and social flexibility. All of these competencies are grounded in personal values which are practiced and supported on a daily basis in the workplace. Creating a positive, values-based environment enables a workplace that is productive and prepared to focus on positive impact consistent with ethics and integrity.

  • Happiness – building a values led organization (Esther McMorris) – Ethical motivation is one of the distinctions between management and leadership. Managers who do not embrace a values-driven purpose do not establish credibility as leaders.
